The Commercial Claims Manager , reporting to the Regional Leader - Contract Management, is responsible for claims management arising from the execution (OTR) of complex power projects within various contractual relationships (customer, consortium or collaborative partners, insurers, subcontractors and suppliers). Claims management is integral to project and contract management, with a proactive approach to pursuance, avoidance, mitigation and resolution of claims for and against Arabelle Solutions to maximize operational and financial performance while reducing commercial and financial risks.

Functional reporting: the Commercial Claims Manager reports to the Regional Leader - Contract Management and collaborates with project stakeholders, including the Project Manager (Commercial) for each project, to drive claims to resolution and settlement with the best possible outcome for Arabelle Solutions.

Roles & Responsibilities

  • Establish project-specific claim strategies in collaboration with the Project Managers (Commercial) and ensure implementation
  • Establish and maintain project/subcontract claim procedures
  • Collaborate with Planners/Schedulers to optimize project programs for potential claims
  • Lead claim-related risk identification, quantification and mitigation

Commercial Awareness and Tools

  • Implement the company’s claim management process and required tools on designated projects
  • Increase commercial awareness within projects through tools, processes and trainings
  • Identify claim management gaps and close them
  • Implement an effective system for record creation, storage and access
  • Provide tools and best practices of claim management to project teams

Claim Management

  • Achieve claim management objectives related to delays, productivity, labor and material costs, design issues and contract interpretations
  • Manage claims with specialist functions (legal, planning, insurance, tax, finance, etc.)
  • Prepare, negotiate and settle claims against customers, partners, insurers, subcontractors and suppliers, and defend claims against Arabelle Solutions
  • Develop and manage claim-specific action plans
  • Lead external law firms and consultants for claim preparation as appropriate
  • Prepare claims considering: contractual terms, pricing, rates and productivity; records and notices; time spent; costs; productivity; escalation costs; detailed cause-and-effect analyses; critical path; contractual remedies; baseline vs executed schedules; assess fault and responsibility

Reporting

  • Ensure claim filing systems and registers are established and maintained
  • Present major claims to Claim Review Boards and senior executives
  • Report progress, settlement estimates and outcomes to senior leadership

Return on Experience and Trainings

  • Provide training to project teams on claims management, procedures and tools
  • Contribute to ongoing development of internal claims expertise by capturing lessons learned

Qualifications

Candidates must present the following qualifications to be considered:

  • University Degree in Contract Management, Quantity Surveying, Business or Law
  • 8+ years of experience in claim management/contract management in an international project or construction environment
  • Experience with dispute resolution procedures and methodologies
  • Expertise in delay analysis, quantum techniques and productivity loss assessment
  • Proven track record in cost and extension of time claims preparation and settlement
  • Strong analytical, negotiation and strategic thinking skills
  • Broad commercial knowledge and ability to interpret construction contracts, drawings and specifications
  • Ability to develop claim strategies and understand EPC contracts and contract law principles
  • Leadership and ability to motivate a team even without direct reporting line
  • Advanced computer skills (Windows, Word, Excel, etc.)
  • Fluent in written and spoken English; ability to work in international teams

Desirable Qualifications

  • Professional certification (ICC, IMI, RICS, IDRRMI or equivalent)
  • Project management experience or professional registration
  • Excellent written and verbal communication skills with stakeholders
  • Knowledge of nuclear power plant characteristics and project development
  • Open to feedback, able to handle conflicts
  • Cultural awareness and team player
  • Primavera P6 scheduling capabilities
  • Additional French language skills
